Property Boundary Lines in Real Estate. So you think you know your true property boundaries on all sides of
your RI real estate? Take another look, get out the ruler and guess what? It just is not good enough. One of many things that homeowners take for granted are the property boundaries on their property. Rhode Island does not require a survey of the property prior to closing to ensure boundaries are fully understood by the new buyers.

When sellers tell me after listing the real estate that 1) oh my neighbor's driveway is on my property, 2) the fence on the left side is off by several feet, etc. I just start to cringe. Full disclosure is always needed to the new buyer. I advise that it is put it in writing and have the buyer sign acknowledgement of the facts you have conveyed to them.
Last year a neighbor came storming into a very busy open house I was having to let me and all the property visitors know that according to 'her' the property line was all wrong. As I gently took her outside, I ask her if she had talked to my sellers about it since it impacted their home sale. Oh no she said, my husband and I have measured it and we are moving the fence over. Hold on I said...not without a survey was my response. Eventually the property boundary line was established on this piece of real estate and the neighbor was in the wrong. The surveyors neon markers clearly indicated it.
All the stress this boundary line created could have been avoided if RI state law mandated property surveys prior to home closings. For now it is up to real estate agents to act responsibly and buyers to be aware...Property Boundary Lines in Real Estate.
