There is so much to enjoy when you have beautiful tall trees pepperting your property or your neighbors. But there are times when trees will fall due to wind and water and the ensuing damage can impact neighbors. Although the first call besides the tree man to find out how much it is going to cost to remove the tree is to your insurance adjuster. And that is where homeowners learn they do not know what is and is not covered in their homeowner's policy. It is always wise, depending upon your location & surrounding land, to talk to your insurance agent about trees and trees falling down.
Let's say it is the neighbor's tree that falls on your yard not hitting the house and the neighbor says I'm not taking care of it?! Yeah, there really are neighbors like this in our world! So you talk to your insurance company and they say well since it was due to wind we will not cover it (Act of God is another comment made by the insurance adjuster) but we will give you $X. Now the adjuster said if it fell on the house we would pay for all house repairs and the tree removal. Interesting how this process works in insurance and most of us are clueless on the specifics.
Now in this case I imagine that the insurance client's insurance company will go after the neighbor's insurance company (who will not pay for their client's felled tree) to recoup some monies. Yet no guarantees. After the five wicked Northeaster storms we had this spring in New England I can not imagine any of this being resolved soon! So have a 'tree guy' you trust and make sure you know your homeowner's policy well. In insurance it is all about understanding. When it impacts RI real estate, my Realtor job is to ensure that a homeowners house still closes and both buyers and sellers are happy with the tree outcome.
